These SMS Terms and Conditions ("Terms") govern your participation in the Jacobsen Daily Site Reporting text messaging program (the "Program"), operated by Jacobsen Construction Company, Inc. ("Jacobsen," "we," "us," or "our"). The Program is part of the Jacobsen Internal application (the "App").

By opting in to the Program, you agree to these Terms and to our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree, do not opt in.

2. Who the Program is for

The Program is for Jacobsen employees, subcontractor personnel, and other project team members who are assigned to Jacobsen construction projects and who submit daily field reports. Most participants are project members whose name, email, company, and job title are synced from Autodesk Construction Cloud (ACC) for the Jacobsen projects they work on.

To take part, you must:

  • be at least 18 years old;
  • be the account holder of the mobile number you enroll, or have the account holder's permission to enroll it; and
  • use a mobile number on a U.S. wireless carrier that supports text messaging.

3. Program description

The Program lets you build your daily site report by text message instead of filling in a form. An automated reporting assistant sends you messages and reads your replies. The assistant uses artificial intelligence (AI) to understand your replies and write its responses.

3.1 Messages you may receive

  1. Replies to your messages. When you text the Program number with updates during the day (for example, work performed, crews on site, equipment, materials, deliveries, visitors, weather, delays, or safety notes), the assistant replies to confirm what it recorded or to ask a short clarifying question.
  2. End-of-day wrap-up prompt. At about 4:00 PM Mountain Time on reporting days, the assistant may send one message asking for any report details that are still missing.
  3. Follow-up questions. After the wrap-up prompt, the assistant may ask follow-up questions, one at a time, about missing details such as crews, worker counts, regular and overtime hours, work performed, equipment, materials, visitors, and safety incidents.
  4. Report confirmations. When you submit your report or save it as a draft, the assistant sends a confirmation, and may send a summary of your report for you to review.
  5. Attachment confirmations. When you send photos, documents, or voice notes, the assistant may confirm that they were received and attached to your report.
  6. Program service messages. These are opt-in confirmations, HELP replies, and the confirmation that you have opted out.

3.2 Sample messages

  • "Hi Alex — it's 4 PM wrap-up time. Which companies and crews were on site today, how many workers, and what hours? (Or say skip.)"
  • "Got it — noted 2 excavators and a skid steer on site. Any materials delivered today?"
  • "Report submitted and saved. Have a good evening."
  • "Jacobsen Daily Reporting: For help email support@jacobsenconstruction.com or call (801) 973-0500. Msg & data rates may apply. Reply STOP to opt out."
  • "Jacobsen Daily Reporting: You have been unsubscribed and will receive no further messages. Reply START to resubscribe."

3.3 What the Program does not send

The Program does not send marketing, advertising, promotional offers, or sweepstakes messages. It does not send messages for third parties, and it does not send content that is unrelated to daily site reporting.

3.4 Messaging channels

Messages may be delivered as standard SMS/MMS or, if your device supports it, as iMessage or RCS. These Terms apply in the same way on every channel. Messages are sent from Jacobsen's dedicated Program number(s): +1 (617) 422-1629.


4. How you opt in

You opt in through the SMS consent page in the App:

  1. Sign in to the App and select your project-member profile.
  2. Open the SMS consent page.
  3. Enter or confirm the mobile number you will use on site.
  4. Read the disclosure shown on the page:

    Jacobsen Construction may send automated text messages about daily site reporting, including reminders and follow-ups. Message frequency varies. Message and data rates may apply. Reply STOP to opt out, HELP for help. Consent is not a condition of employment.

  5. Check the box labeled "I agree to receive SMS / iMessage daily-report texts at this number." The box is not checked for you.
  6. Select Agree & continue.

The consent page links to these Terms and to our Privacy Policy.

Records of your consent. When you opt in, we record the mobile number, the date and time, the consent method (web form), the version of the disclosure you accepted, and the IP address your request came from. We keep these records as proof of your consent, as described in the Privacy Policy.

If the disclosure changes. If we make a material change to the disclosure, we will give it a new version number and may ask you to opt in again before sending you more messages.

Texting us first. If you text the Program number before completing the opt-in, we may reply only to your message. We will not send recurring or automated messages, such as the wrap-up prompt, until you have opted in.

Consent is optional. You do not have to opt in as a condition of employment, engagement on a project, or any purchase. You can submit daily reports in the App or through any other method your supervisor approves.


5. Message frequency and timing

Message frequency varies with your activity. Most messages are replies to messages you send. On a typical reporting day, expect about 1–10 messages from the Program, and more if you send many updates or the report needs several follow-up questions.

Automated messages that you did not prompt, such as the wrap-up prompt, are sent only during working hours (about 9:00 AM to 5:00 PM Mountain Time). They are never sent before 8:00 AM or after 9:00 PM in your local time zone. Replies to your own messages may be sent whenever you write to us.


6. Cost

Message and data rates may apply. Your wireless carrier may charge you for messages you send and receive, and for data used by iMessage, RCS, or MMS, depending on your plan. Jacobsen does not charge you for the Program. Contact your carrier for details about your plan. If you use a company-issued device, your company's mobile policy may also apply.


7. How to opt out (STOP)

You can cancel at any time by replying STOP to any Program message. We also accept STOPALL, UNSUBSCRIBE, CANCEL, END, QUIT, REVOKE, and OPTOUT, as well as other reasonable requests to stop, such as "stop texting me."

After you opt out:

  • you will receive one final message confirming that you are unsubscribed;
  • we will not send you any more Program messages unless you opt in again;
  • your opt-out is recorded in your profile and on the Program number; and
  • your report data that already exists is kept as described in the Privacy Policy. Opting out of texts does not delete project records.

You can also opt out by emailing support@jacobsenconstruction.com or by telling your Jacobsen project administrator. We will process these requests within 10 business days.

To opt back in, reply START, YES, or UNSTOP to the Program number, or complete the opt-in on the SMS consent page again.

9. Supported carriers and delivery

The Program is available on major U.S. carriers, including AT&T, T-Mobile, Verizon Wireless, and many regional and prepaid carriers.

Wireless carriers are not liable for delayed or undelivered messages. Delivery is not guaranteed. It can be affected by coverage, your device settings, carrier filtering, network congestion, and other things outside our control. Do not rely on the Program for time-critical communications.


10. AI-assisted messages

The Program's replies and follow-up questions are written automatically by AI systems, not by a person in real time. AI can make mistakes. Before you submit, check the report summary the assistant gives you, and correct anything that is wrong. You are responsible for the accuracy of the information you report.


11. Your responsibilities and acceptable use

When using the Program, you agree to:

  • give accurate, truthful information about site activities;
  • send only information related to Jacobsen project work;
  • not send unlawful, harassing, threatening, or obscene content. Messages with profane or abusive language may be flagged for review in project summaries;
  • not send sensitive personal information that the report does not need, such as Social Security numbers, bank or payment card numbers, passwords, or detailed medical information about yourself or others. If you need to report a safety incident or injury, describe what happened at the level a daily report requires and follow Jacobsen's incident-reporting procedures;
  • not send photos, documents, or recordings that you are not allowed to share, or that show people who have not agreed to be recorded where the law requires their agreement;
  • report safety emergencies through the proper emergency channels (call 911), not through the Program. The Program is not monitored in real time and is not an emergency service; and
  • tell us, or reply STOP, if you change or give up your mobile number.

We may suspend or end your participation if you misuse the Program.


12. Ownership and use of report content

Daily reports, messages, photos, documents, and voice notes you submit through the Program are business records of Jacobsen and of the related construction projects. We may use them as described in the Privacy Policy. This includes compiling them into daily reports and site-wide summaries, and syncing them to Jacobsen's project-management systems, such as Autodesk Construction Cloud.


13. Privacy

We collect, use, and protect information from the Program as described in our Privacy Policy.

We do not sell, rent, or share your mobile phone number or your SMS opt-in data and consent with third parties or affiliates for their marketing or promotional purposes.


14. Changes to the Program or these Terms

We may change, suspend, or end the Program, or update these Terms, at any time. When we update these Terms, we will change the "Last updated" date and post the new version on this page. If a change is material, such as a change to the kinds of messages we send, we will notify you by text or in the App, and may ask you to opt in again. If you keep participating after the changes take effect, you accept the updated Terms. If you do not agree, reply STOP.


15. Disclaimers

THE PROGRAM IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, JACOBSEN DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT MESSAGES WILL BE DELIVERED, TIMELY, OR ERROR-FREE, OR THAT AI-GENERATED CONTENT WILL BE ACCURATE.

16. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, JACOBSEN AND ITS AFFILIATES, SERVICE PROVIDERS, AND WIRELESS CARRIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY DELAYED, UNDELIVERED, MISDIRECTED, OR INACCURATE MESSAGES, ARISING FROM OR RELATED TO THE PROGRAM. Nothing in these Terms limits any rights you have as an employee under applicable law.


17. Governing law

These Terms are governed by the laws of the State of Utah and applicable U.S. federal law, including the Telephone Consumer Protection Act (TCPA), without regard to conflict-of-laws rules.
