How Jacobsen Construction handles personal information for the App and daily-report SMS program.

This Privacy Policy explains how Jacobsen Construction Company, Inc. ("Jacobsen," "we," "us," or "our") collects, uses, shares, keeps, and protects personal information through:

  • the Jacobsen Internal web application, including its chat, voice ("talk"), report, and admin features (the "App"); and
  • the Jacobsen Daily Site Reporting text messaging program (the "SMS Program"),

together, the "Services." It should be read together with our SMS Terms and Conditions.

The Services are internal business tools. They are used by Jacobsen employees, subcontractor personnel, and other project team members to create daily construction field reports. This Policy does not cover Jacobsen's public website or our general employment practices. Those are covered by separate notices.


1. Summary

  • We collect your contact and project details, the messages, photos, documents, and voice notes you send, and records of your SMS consent.
  • We use this information to run daily site reporting: to message you, write and file your reports, and produce project summaries.
  • AI service providers process your messages and voice notes to understand them, reply to you, and write report summaries.
  • We do not sell your personal information. We do not share your mobile number or SMS consent with anyone for marketing.
  • You can stop text messages at any time by replying STOP.

2. Information we collect

2.1 Profile and contact information

2.2 App account information

If you have a login for the App, we collect your email address, first and last name, password (stored only as a salted hash), email verification status, one-time passcodes (OTP) used for sign-in or verification, an optional profile picture, and authentication tokens stored in secure browser cookies.

2.3 SMS consent records

When you opt in to the SMS Program, we record:

  • that you opted in (yes/no);
  • the date and time of consent;
  • the consent method (for example, "web");
  • the version of the consent disclosure you accepted (for example, sms-consent-v1);
  • the IP address from which you submitted consent; and
  • the mobile number you enrolled.

We also keep records of opt-out (STOP), opt-back-in (START), and HELP requests.

2.4 Messages and report content

  • Message text. The content of every message you send to, and receive from, the reporting assistant, by SMS, iMessage, RCS, or the App's chat, along with the order and time of each message.
  • Message metadata. Information the messaging provider sends with each message, such as sender and recipient numbers or handles, message IDs, timestamps, delivery status, and channel type.
  • Daily report data. Information drawn from your messages: report date, work performed, crews and companies on site, worker counts, regular and overtime hours, equipment, materials and deliveries, visitors, safety incidents and safety notes, key communications, general notes, and whether the report was submitted or saved as a draft.
  • Attachments. Photos, documents, and other files you send, including their filename, file type, and size. Photos and files may contain information about other people, such as their faces or names, as well as location metadata (for example, GPS data embedded in a photo).
  • Voice notes and voice sessions. Audio you record in the App or send as a voice note, and text transcripts of that audio. In "talk" mode, your voice is streamed in real time to our voice-agent provider. That provider converts your speech to text and replies with synthesized speech.
  • Content flags. Automatic markers we add to messages and reports. These note profane or abusive language, and certain keywords that may need management attention, such as "injury," "claim," "change order," "critical path," "contract," or "manpower."

2.5 Information created about your use

  • Session records: date, status (in progress, completed, draft, abandoned), mode (chat or talk), and wrap-up progress.
  • Report sync records: whether a report was synced to ACC, when, and any sync errors.
  • Site-wide daily summaries that combine reports from several workers for a project or for the whole company.

2.6 Technical information

  • IP address, browser type, device type, and operating system.
  • Server, security, and error logs, including timestamps and requests made to the App.
  • Signatures used to verify webhooks from our messaging provider.

The App uses only strictly necessary cookies and local browser storage, such as login tokens and the project-member profile you selected. We do not use advertising cookies or third-party tracking pixels.


3. How we use information

4. How we use AI

The Services use AI to understand your messages and to write replies and reports.

  • Conversation. Your message text, the recent history of that day's conversation, and our instructions are sent to an AI language model provider. The provider writes the assistant's reply and pulls report details out of your messages.
  • Transcription and voice. Voice notes and live voice sessions are sent to a speech-to-text provider for transcription. In live voice sessions, a text-to-speech provider turns the assistant's replies into audio.
  • Summaries. Your submitted daily reports, and selected parts of your messages, are sent to an AI provider to create site-wide daily summaries and to answer questions about those summaries from authorized Jacobsen staff.

We require AI providers to process this data only to provide services to us, under their business or API terms. Under those terms, the providers do not use API data to train their models by default. AI output can be wrong, so you can review and correct your report before you submit it. The Services do not use AI to make decisions about hiring, firing, pay, or discipline.


5. How we share information

We share personal information only as described below.

5.1 Service providers (processors)

We use the following kinds of vendors to run the Services. They may use personal information only to provide services to us:

We may change providers over time. We will keep this list reasonably up to date.

5.2 Within Jacobsen and project teams

Your daily reports, attachments, and summaries are available to authorized Jacobsen personnel and project stakeholders who need them. This includes project managers, superintendents, safety staff, and administrators. Reports synced to Autodesk Construction Cloud can be seen by project members according to that project's ACC permissions.

5.3 Legal, safety, and business transfers

We may disclose information:

  • to comply with law, regulation, subpoena, court order, or other legal process;
  • to respond to lawful requests from government authorities, including safety regulators such as OSHA;
  • to establish, exercise, or defend legal claims, including construction claims and disputes;
  • to protect the rights, property, or safety of Jacobsen, our workers, project owners, or the public; and
  • as part of a merger, acquisition, financing, or sale of all or part of our business, in which case this Policy continues to protect the information.

5.4 SMS and mobile information

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing with subcontractors in support of our services, such as customer service and message delivery, is permitted. All other categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

5.5 No sale of personal information

We do not sell personal information. We do not share it for cross-context behavioral advertising.


6. Data retention

We keep personal information for as long as we need it for the purposes in this Policy. The table below shows typical retention periods:

When information is no longer needed, we delete it or de-identify it. We may keep information longer if the law requires it, or if it is subject to a legal hold.


7. Security

We use reasonable administrative, technical, and physical safeguards, including:

  • encryption in transit (HTTPS/TLS) for the App, APIs, and connections to providers;
  • encrypted cloud storage for files and databases;
  • passwords stored only as salted hashes, plus one-time-passcode verification;
  • role-based access controls, with admin access limited to authorized staff;
  • signature checks on inbound messaging webhooks; and
  • access logs and monitoring.

No system is completely secure. If a security incident affects your personal information, we will notify you as required by law.


8. Your choices and rights

  • Stop text messages: Reply STOP to any Program message, email support@jacobsenconstruction.com, or tell your project administrator.
  • Get help: Reply HELP, or contact us using the details below.
  • Change your number or profile: Contact your project administrator or support@jacobsenconstruction.com. Profile details synced from ACC may need to be updated in ACC.
  • Access, correction, deletion, and portability: You may ask for access to, correction of, deletion of, or a copy of your personal information by emailing privacy@jacobsenconstruction.com. We will verify your identity before acting on the request. We may keep information that we must retain by law, or that is part of project business records, such as submitted daily reports. We will tell you if we do.
  • State privacy rights: Depending on where you live (for example, California), you may have more rights under state privacy laws. These can include the right to know, delete, and correct personal information, and the right not to be discriminated against for using these rights. You can use these rights through the contact details below, or through an authorized agent. We do not sell or "share" personal information as those terms are defined by law, and we do not use sensitive personal information for purposes that require an opt-out.

Using any of these rights, including opting out of text messages, will not affect your employment or project engagement.


9. Location of processing

The Services are hosted in the United States. Some service providers may process information in other countries. When they do, we rely on contractual safeguards.


10. Children's privacy

The Services are workplace tools meant for adults. They are not directed to anyone under 18, and we do not knowingly collect personal information from children. If you believe a child has provided information to us, contact us and we will delete it.


11. Changes to this Policy

We may update this Privacy Policy from time to time. When we do, we will change the "Last updated" date and post the new version on this page. If a change is material, we will notify you in the App or by text message before it takes effect.
